This bachelor thesis describes recovery of debts. It’s main focus is to provide analysis of legal regulations related to recovery of debts by court and executor. It gives a summary about process at execution of resolution and execution. Simultaneously, this paper’s trying to find way, how to improve effectiveness of recovery of debts.

The main subject of my bachelor thesis is a recovery of the outstanding claims, its methods and relevant legal instruments. A special part of my thesis is focused on the definition of the legal terms, e.g. Execution of the Resolution, Execution, Claim, etc. Furthermore, the comparison of the terms Execution of the Resolution and Execution itself is a part of my thesis. The legal position of the Executor as a relatively new institution on this field according to law of the Czech Republic also creates a special part of my work. The another part of my work contains the summary of the legal procedure of the execution and presentation of some practical examples.
Execution by sale of real estate

This rigorous thesis conducts a detailed analysis of one of the most effective methods of execution - which is, certainly, the sale of real estate - and it does so from the very beginning (meaning the issuance of execution order) to the satisfaction of the plaintiff's (or other creditors') claims. Although the involuntary auction of real estate is accurately determined in legal act as the ultimate option for satisfaction of creditors' claims, the frequency of real estate auctions is, in fact, relatively high. Therefore, the control over the fundamental steps that the bailiff must take strictly according to the letter of the law cannot be neglected as it may result in an illegal process otherwise. And it is more than appropriate to have an awareness of your rights. This work is a suitable material for the purpose. The principal case law of the courts, professional literature, monographs, various professional articles and other sources were synoptically processed by the author in the course of which they were subject to a thorough analysis that simultaneously incorporated the author's practical knowledge. Social analysis of debtors in Prague 3 - Žižkov

The bachelor paper "Social analysis of the indebted citizens in Prague 3" focuses on the issues of indebtedness, respectively overindebtedness, it's causes and consequences for single person, or the whole population. The essay tries to answer the question about the origin of overindebtedness, options of it's solution and prevention. The theoretical part deals with the issues by historical aspect and the law aspect too, mainly is focused to the execution of the decision carried out by sale of movable things, and advise for individuals. The research part works with the question, which segments of population the indebtedness concerns at most, by the aspect of gender, age, employment, nationality and education, focused for Prague 3.

Costs of enforcement proceedings Abstract This rigorous thesis reflects the legal standards of the costs of distrainment proce- edings. Commonly used terms and their functionality are spelled out after the thesis ge- neral introduction. Furthermore, the thesis deals only with the incurred costs in the last phase of civil proceedings - enforcement proceedings. The second chapter is designed to the introduction of the costs legal regulation of the execution proceedings and also to outline the basic legislative development from 2001 to the present. Moreover, describes the relationship between the Enforcement and the Code of Civil Procedure. The main pilar of this thesis, third part, describes the all individual costs (i.n. the distrainer's fees, overheads and other expenses). A separate chapter is devoted to the costs of the benefici- ary. The fifth chapter includes an explanation of the concepts of payment, reimbursement and enforcement of costs, focused on the institutional execution specifics. Enforcement of judgment under the Execution Procedure Code - general aspects of the execution proceeding In my study I deal with the issue of execution proceeding and at the same time I focus on its general part. The legal regulations with respect to execution through court executors represent a fairly new concept in the Czech Republic which had been substantially developing during its ten - year "history". In my thesis I pay specific attention to those provisions with difficult and problematic interpretation in judiciary practice and also to amended enactments of Execution Procedure Code. My study is divided into several chapters. First chapter is logically the introduction that along with the second chapter attempts to make the reader familiar with the issue of execution proceeding. The third chapter forms the most important part of my study, since it describes the actual execution proceeding. The fourth chapter concerns relatively delicate subject namely adequacy of the execution and also the various types of execution. The fifth chapter of my paper should summarize the so far essential amendments of the Execution Procedure Code from its adoption till the present day. Comparison of an execution of ruling (based on Act No. 99/1963) and a distrainment (based on Act No. 120/2001) from a creditor's point of view

The theme of the thesis is the law enforcement in accordance with Part Six of the OSŘ and its comparison with the legislation of civil law execution by Act No. 120/2001 Coll. The aim of this work is to describe the rules of inforcement by the OSŘ and the execution by the EŘ, define the basic differences between the two processes, reflect on the meaningfulness of this dual regulation, as well as the advantages and disadvantages of performance leadership decision one way or another. The work deals with the relationship between the two rules as lex generalis and lex specialis, and a description of significant differences between the modes of enforcement, as shown in both treatments.

Problems concerning collection of recoverable debts in legal theory and court practice

The subject of this thesis is to evaluate the issue of judicial enforcement of claims in legal theory and practice. The first part is devoted to an explanation of key concepts in terms of legislation. The next part shows the possible ways of enforcing judicial claims. The final part evaluates the results in terms of qualitative and quantitative indicators.
